Terms & Conditions

The present general conditions of sale are only applicable to the sales of products offered directly by Access Trading SRL (below referred as “Access Trading”) on the website www.giulbrand.com All products are sold new. These general conditions are applicable, excluding all other conditions, in particular those applicable in physical shops selling these products.

 

Article 1 - Prices 

            1.1       The prices of our products are indicated in euros, including taxes (VAT) but excluding the shipping costs which will depend on the country of delivery (except any other provisions to the contrary)
            1.2       Access Trading has the right to modify these prices at any time. However, products will be invoiced based on the prices in force at the time the order was placed.
            1.3       The products remain the entire property of Access Trading until the transaction is fully completed and the full payment is received by Access Trading.
            1.4       The products sold on this website are for private use only (not for trade).

                       

Article 2 - Order

            2.1 Once you have placed an order on our website, you will receive a confirmation by email to the email address you have entered. Once you have received confirmation, the contract is binding.   
            2.2 Access Trading has the right to cancel or refuse to process any order from a customer with whom there is a pending dispute regarding the payment of a previous order.

 

Article 3 - Acceptance and validation

            3.1       By validating your order, you declare having read and accepted the present general sales conditions in their entirety. The data registered on Giulbrand's website (www.giulbrand.com ) constitutes the evidence of all transactions made between Access Trading and its customers except any other evidence to the contrary.

 

Article 4 - Availability ; out of stock ; product information

            4.1       Our products range is available and our prices are valid as long as they are visible on our website and are in stock. If a product becomes unavailable after ordering, we will inform you by e-mail as well as when they are back in stock. Your order will automatically be cancelled and you will be reimbursed if your account has been debited.
            4.2  You will find the product description (colour, size, type…) and digital photos for each item. We have made our best efforts to ensure that the descriptions and colours are as accurate as possible. However, the image  and colour may vary depending on the quality of your screen. We therefore cannot guarantee that your screen will correctly display all the features of the chosen item.

 

Article 5 - Delivery 

            5.1 General

The products bought on our website can be delivered all over the world with  Bpost. The delivery period indicated when making an order is based on estimations.  It corresponds to the time needed to ship and dispatch the goods. Products are delivered to the address you have indicated when making the order. In the event  the address on your order is incorrect, Access Trading is not responsible if you have not take delivery of your order. When you order several items at once, if these products have different delivery periods, the longest period is applicable. Access Trading has the right to delay any shipment.  If some items ordered at the same time through a single transaction are shipped separately, any fees for postage and packing will be invoiced for one single shipment. Access Trading is not responsible for any consequences due to any longer delivery time.

            5.2 Delivered items

                  You must inform Access Trading of any problems regarding the delivered products (e.g. damaged package, opened packages, missing pieces etc.) within seven (7) days after     delivery. Depending on the circumstances as described under article 7 below, you may benefit from an exchange or the full reimbursement.

 

            5.3 Delivery details 

                   Orders are processed from Monday to Friday, except on Belgian bank holidays. Products are sent by Bpost from Belgium. The maximum delivery periods vary between two (2) days and two (2) weeks after receiving the payment depending on the city or country of destination. Access Trading is in no case responsible for delays beyond its control due to a backlog attributable to Bpost or one of its suppliers. All items that are out stock will automatically be deducted from the order.

            5.3 Delivery : additional cost

                   When a purchase is made and a package has to be delivered internationally outside the European Union such as for example in the United States, it may be subject to additional costs such as import taxes, customs duties, and/or fees imposed by the destination country. These charges are generally due once the package arrives in the destination country. The buyer is solely responsible for the payment of all customs duties and all other extra taxes and fees charged by the destination country or state. Certain countries may require certain documentation before the items are sent. If the necessary information is not provided, this may result in delays in the order.

 

Article 6 - Payment

            6.1   To pay for your order, you will be directed to a secure payment page on our Website. All payments will be processed using a secure encrypted procedure to prevent the interception of information provided by the buyer.  The electronic payment system used is stripe.

             

Article 7 - Returns & Reimbursement

            7.1 If one of the products purchased does not suit you, you have the statutory right to cancel your order within fourteen (14) calendar days from the day following the delivery in accordance with European and national legal provisions. All cancellation after this period will not be accepted.

 

            7.2 The buyer has the right to return any delivered item according to article 7.1 above but only if it is undamaged, in perfect condition and unused  (with the exception of the normal fitting such as in a shop).  The original labels and tags must still be attached as well as the original packaging. We will promptly and within no more than 14 days exchange the goods or refund all payments received for the cancelled order.

 

            7.3 When a delivery is late for more than (30) days, you may cancel your order and request to be reimbursed for the cost of the product purchased and any return charges. In this case, if you have received the product after your cancellation, we will reimburse you when we have received the product back in its original state.

 

            7.4 Reimbursement will be made on the account number and invoicing address communicated by the buyer, within fourteen (14) days. We are not responsible for any exchange rate fluctuations between the currency used for the initial payment and the currency of your credit card or bank account when the amount is refunded.

            7.5 The return is at the customer's expense.

 

Article 8 - Security

            8. 1      All orders processed via our website are secured through the payment providers in order to protect any data regarding purchases as efficiently as possible.

 

Article 9 - Customer service

            9.1 For all information or any questions regarding products and deliveries, our customer service is at your disposal via e-mail at [ info@giulbrand.com] on weekdays from 9am to 5pm.

 

Article 10 - Intellectual property

                   All texts, illustrations and images on our website are protected by European intellectual property law. Only a private use is authorized. Total or partial reproduction of our website is strictly forbidden. Anyone wishing to use our logo or branding  for promotion on their blog, personal website or other media, is encouraged to first contact us through our website.

 

Article 11 - Liability

                  The products on this website are offered in compliance with Belgian law. It is the customer's responsibility to check any legal local restrictions regarding the import and use of the item he/she wants to order. Please contact info@giulbrand.com  in case you have any question regarding a particular product. Access Trading is not liable for any indirect damages, losses or costs that could be the result of the purchase and is not responsible for any services provided by third parties with witch it collaborates such as shipping companies and payment service providers.

 

Article 12 -  Guarantee

            12.1     We undertake to reimburse or exchange any defective item that do not correspond to your order in accordance with article 7 that specifies the details and procedures for reimbursement. In all cases, you benefit from the legal guarantees regarding the conformity of the goods with the contract and latent defects, in accordance with the relevant legal provisions. The provisions of this article do not prevent you from benefiting from the retraction rights in Article 7.

 

Article 13 -  Applicable law -  Disputes       

            13.1     The present contract is subject to Belgian law.
            13.2    The language of the present contract is English.
            13.3     Any dispute relating to the interpretation or performance of this contract is subject to the exclusive jurisdiction of the courts of Brussels in Belgium.

            14.1     Information and data concerning your identity are necessary for managing, your order and for our commercial relationships. They may be passed on to companies that contribute to these relations such as companies that execute services and orders, for their management, execution, processing and payment. This information is stored according to Belgian law on Privacy Protection on personal data. You have the right to access, correct and delete personal details.
